GENERAL CONDITIONS

1. The terms and conditions of sale apply to all persons (hereinafter the Client) who place orders for goods from the online store www.glairybrand.com (represented by Glairy Brand OÜ), thereby concluding a purchase and sale agreement. Purchases from www.glairybrand.com may be made by private individuals, companies, and non-profit organizations.

2. By accepting these terms and conditions, the Client confirms that they have read, understood, and agreed to the terms of the sales contract and undertake to comply with them.

3. By registering as a user of Glairybrand.com and/or purchasing products, the Client agrees to the terms of this contract as well as the rights and obligations arising from the laws of the Republic of Estonia.

4. Glairybrand.com reserves the right to make changes to the terms of sale and sales prices. Such changes will be reflected on the Glairybrand.com website.

ENTRY INTO FORCE OF THE SALES CONTRACT

1. Glairy Brand OÜ sells, and the Client purchases, the offered products either through the online store, by phone, by email, or directly through an authorized representative of Glairy Brand OÜ.

2. A sales contract between Glairy Brand OÜ and the Client enters into force when:
• For private clients – after the payment amount has been received in the bank account of Glairy Brand OÜ based on the order confirmation from the online store.
• For business clients (payment by invoice) – after the order has been confirmed through the online store, or when an authorized representative of Glairy Brand OÜ has accepted and confirmed the Client’s order either verbally or in writing.

PRICES

1. All prices displayed in the Glairybrand.com online store are in euros and include 20% VAT.

2. Glairy Brand OÜ reserves the right to adjust prices. If the Client submitted their order before the price change took effect, the price valid at the time of placing the order will apply. The Client has no right to claim compensation for price differences.

ORDER PLACEMENT AND PAYMENT FOR GOODS

To order goods, add the desired products to the shopping cart. To complete the order, fill in the required fields and choose a suitable delivery method. The total amount to be paid will then be displayed on the screen and can be securely paid using the following methods:

Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Pocopay
Visa/Mastercard payments

NB! When paying via bank link, be sure to click the “Return to merchant” button on the bank’s page.

Payments are processed by Maksekeskus AS. Payment takes place outside the online store in a secure environment – via the respective bank’s secure environment for bank link payments and in Maksekeskus AS secure environment for credit card payments. Glairy Brand OÜ does not have access to the Client’s bank or credit card details. The contract enters into force once the payment amount has been received in Glairy Brand OÜ’s bank account.

Glairy Brand OÜ is the controller of personal data and transmits the personal data necessary for making payments to the authorized processor Maksekeskus AS.

If the ordered goods cannot be delivered due to the product being out of stock or for any other reason, the buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded promptly, but no later than 14 days after the notification has been sent.

DELIVERY

Goods are shipped to the following country: Estonia

The Client can choose between the following delivery options: DPD parcel locker, Omniva parcel locker, Itella Smartpost parcel locker.

The Client bears the shipping costs, and the respective price information is displayed next to each delivery option.

Domestic shipments within Estonia generally reach the destination specified by the buyer within 2–3 business days from the entry into force of the sales contract.

In exceptional cases, the delivery time may be up to 45 calendar days.

Shipments damaged during transport, where the products (but not the packaging) are harmed, will be replaced for the Client. If the Client receives a defective or incomplete product, they must not use it and must immediately notify Glairy Brand OÜ. If replacement is not possible, the product cost will be refunded.

RIGHT OF WITHDRAWAL

1. After receiving the order, the Client has the right to withdraw from the contract concluded in the online store within 14 days.

2. Returned goods must be unused, undamaged, and in their original packaging.

3. The Client bears the cost of returning the goods, except in cases where the reason for return is a product defect or a wrong item.

4. To return goods, the Client must submit a return request in free form to the email address glairy@glairybrand.com within 14 days of receiving the goods. The return request must include the Client’s name, product name, invoice or order number, and the reason for return.

5. The amount paid for the returned goods will be refunded to the Client as soon as possible, but no later than 14 days from receipt of the withdrawal notice.

PROCEDURE FOR SUBMITTING COMPLAINTS

1. According to the Law of Obligations Act, the Client has the right to file a complaint within 2 years from the date of receiving the goods regarding any non-conformity of the product with the contract terms. For defects appearing within the first six months, it is presumed that the defect existed at the time of purchase, and the seller must determine the nature of the defect.

2. Upon discovering a defect, the Client must immediately notify Glairy Brand OÜ by email at glairy@glairybrand.com and provide the following information: name, contact details, and description of the defect. If possible, include the order or invoice number and a photo or video. The use of a defective product must be stopped immediately. If the Client has altered the defective product in any way, the seller has the right to refuse to accept the return.

3. Glairy Brand OÜ is not responsible for:
• Damage caused by the Client’s negligence or improper use of the product.
• Defects arising from misuse of the product.
• Normal wear and tear due to regular use.

LIABILITY AND FORCE MAJEURE

1. Glairy Brand OÜ is liable to the Client, and the Client is liable to Glairy Brand OÜ, for any damages caused by a breach of these terms under the circumstances and to the extent provided by the laws of the Republic of Estonia.

2. Glairy Brand OÜ is not liable for damages caused to the Client or delays in product delivery if the damage or delay was due to circumstances beyond the control or foresight of Glairy Brand OÜ.

PRIVACY

1. By using the Glairybrand.com website, the Client gives explicit and informed consent to Glairy Brand OÜ for the processing of their personal data.

2. Glairy Brand OÜ uses the information provided by the Client solely for the purpose of fulfilling the Client’s purchase order and does not disclose it to third parties.

OTHER TERMS

Disagreements and disputes arising from the fulfillment of these terms shall primarily be resolved through negotiations between the parties. If the disputes arising from the contract cannot be resolved through negotiations, the Client has the right to contact the Consumer Protection and Technical Regulatory Authority or a court to protect their rights. Glairy Brand OÜ also has the right to go to court to protect its rights.
